1. Introduction:

This present document is established by DeejaysGrup SL for the purpose of describing to the client the contract conditions. Once the first expected payment is made within the payment clauses (2), this document together with the quotation, will acquire a contractual nature between the company (DeejaysGrup SL) and the client. The quotation itself is valid for 21 days, subject to changes in supply and demand conditions. As an essential part of the contract, the client must provide DeejaysGrup SL with the Event Script (the company will provide the template to be filled with music preferences) within a maximum of 7 days prior to the event.   

The following conditions for contracting the event services will be governed by current Spanish law and legislation.  

In the event of a controversy over the established terms and conditions, the contracting parties expressly submit to the jurisdiction of the Courts and Tribunals of Palma de Mallorca, waiving any other jurisdiction that may correspond to them  

2. Rates and terms of payment:

– FIRST PAYMENT: Between the confirmation of the event and the following 7 days: a payment of 50% of the total invoice will be required as a reservation fee.

– SECOND PAYMENT: 15 days prior to the event, a payment of the rest of the quotation will be required.

The payment can be done by bank transfer, credit card or cash.  All extra expenses from a bank institution will be covered by the client.  The total cost foreseen in the contract includes VAT at 21%  

DeejaysGrup SL may cancel the event and terminate the contract if the second payment is not made by the client, without the right of compensation or return of the amounts already paid.  

3. Hospitality

The client must supply the service provider with the necessary room to carry out the action, bringing enough power for electricity supply. In addition, they commit to provide access to the venue sufficiently in advance for the preparation and assembly.   

Water (and other beverages) will be provided to the service provider before the performance. Moreover, the client must provide staff menus for the technicians operating during the event.  

In the event that we need to travel outside Mallorca island to carry out the event, the client must bear all the travel expenses such as flights, food, accommodation, etc. 

4. Changes in the contract

In the event of a date modification request, DeejaysGrup SL will try to accommodate the changes, always subject to business availability. This modification request must be informed to the company within a maximum of 7 days before the event.   

The provision of services will have the cost established by the quotation. The total cost  established in it may be subject to change if any of the provided details are altered . These changes must always be agreed  by both parties and will be satisfied as far as possible by DeejaysGrup SL. The extension of the cost must be  paid 15 days before the event.  

5. Eventualities

In case of adverse weather conditions, the client must have provided the assembly of Plan B to DeejaysGrup SL. In situations in which our staff and sound and lighting equipment are affected due to these adverse weather conditions, the customer will be responsible for the repair cost.

6. Business liability:

DeejaysGrup SL must do everything in its power to provide the services in the best possible way. These must be rendered professionally and diligently according to industry standards. If there is a third party provider chosen by the client to provide services similar to those we offer, it will be subject to the express consent of DeejaysGrup SL.   

The assembly of the sound and lighting equipment by the client will not be allowed  Given the existence of possible acoustic restrictions by the space of the event to be held, DeejaysGrup SL will be exempt from any responsibility for the inconveniences caused nor will any compensation be made to the client.  DeejaysGrup SLU will not be responsible, in any case, for damages or accidents that may occur in the event and are not directly caused by our company.  In the event that DeejaysGrup SL does not comply with the provision of the services provided for in the quote, the company will be obliged to reimburse the client for the amount already paid to date.  

7. Cancellation policy

7.1. 7.1. If the client decides to cancel the event due to strictly personal reasons, the total amount already paid to date will not be refunded.

7.2. Any decision to cancel the event must be notified in writing to the company DeejaysGrup SL.

7.3. 7.3. If it is the service provider company that is unable to offer any of the contracted services, DeejaysGrup SL undertakes to supply these services with an alternative with equal or superior quality. In the event that it is not possible to find an alternative with the same conditions, DeejaysGrup SL will return the amount of the contribution already paid less the financial costs that it entails.

In the event of non-compliance with any of the stipulated clauses, the contracting shall be understood as resolved.

8. Artist Booking and Event Cancellations

Once the reservation payment has been made and the event is confirmed, the artists might apply a penalty for the event cancellation. The penalty fee will depend on each artist and time of cancellation.

9. Cancellation policy due to major force

If the event cannot take place due to force majeure (such as pandemics, severe storms, or extreme alerts issued by AEMET) on the initially scheduled date, it will be possible to reschedule it to a later date, subject to the availability of both parties. The quotation established for the original date will be maintained as long as the contractual conditions remain unchanged, and any amount already paid will be held as a deposit for the new date.   

In any case, if the event is postponed to a date beyond the originally scheduled year, a review of costs will be required.  

10. Use of Image, Data and Privacy

Personal data will only be used in order to provide the requested service in the best possible way and will never be shared with third parties outside the company.  

In addition, they can also be used to comply with internal promotions, legal requirements, government requests and/or requests for police investigations subject to illegal actions.  

The company DeejaysGrup SL reserves the right to take photographs and/or recordings of the services offered solely for the promotion of the same company, regardless of whether the client has another exclusive external photography and recording service. The customer shall inform external service providers of our right.

11. Delays in the timing of the event

If there is any change in the timing of the event for which the service provider is not responsible and to which it cannot adapt its performance, there will be no reduction or return in the quote rate.  

In the case of delays in the event due to external circumstances, the supplier may end its services at the previously established departure time. The end time of the event prevails over the duration of the event.   

In the event that the service provider is requested to extend the duration of the action, and the latter agrees, the extension will be possible as long as the service can be paid directly to the agent. In the event that the provider is not willing to extend the performance, they are fully entitled to reject the extension without any type of penalty.
